AgentData is a product of DragApp.com Ltd, registered in England and Wales (company number 10835737), registered office at Building 18, Gateway 1000 Arlington Business Park, Whittle Way, Stevenage, England, SG1 2FP.
1. The service
AgentData provides customer lists of business software (which companies use a technology, how we found it and when), technology detection, company profiles, business contact information and related data, sourced from publicly available web pages and public DNS records. The service is available via our website, REST API, and MCP server, including through connectors in AI assistants such as Claude and ChatGPT.
2. Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Not create more than one account per person
- Be at least 18 years old
You are responsible for all activity under your account.
3. Plans, trials and payment
Plans
| Plan | What it includes |
|---|---|
| No account | Browsing technologies and company records on the website, the first companies of each customer list, and a limited number of company look-ups a day through the website and the API, counted per network address. The MCP server at mcp.useagentdata.com needs an account. No charge. |
| Account without a paid plan | An API key with a daily allowance of company look-ups. No charge. |
| Pro and Business | Full customer lists for a number of technologies, records to download each month, new-customer alerts, team members and higher look-up allowances, as set out for each plan on our pricing page. Paid monthly or yearly. |
| Enterprise | Agreed with us in writing. |
Prices and allowances for each plan are shown on our pricing page, and API allowances in the API documentation. We may change them for new subscriptions at any time. We will give paying subscribers at least 30 days' notice before raising their price or reducing their allowances, and the change applies from their next billing period.
How allowances are counted
- Technologies:a customer list is unlocked by adding its technology to your account's lists, up to your plan's limit. A removed technology keeps its place in your limit for 7 days.
- Records: one record is one company. A record counts the first time your account downloads that company in a calendar month (UTC). Downloading it again in the same month does not count again, and new customers added to a list you already have are not counted. A download stops when it reaches your allowance. Unused records do not carry over to the next month.
- Team:team members share the account owner's plan, lists and allowances. Team members must work for the same organisation as the account owner.
Free trial
- A trial of Pro or Business lasts 7 days and needs no payment card. Each person and each organisation may have one trial.
- During a trial you can use everything in the plan, except that downloads are limited to the trial's total allowance of records.
- When a trial ends without a paid plan, the account keeps its lists, settings and team but drops to an account without a paid plan. Nothing is charged, because no card was given.
- We may end or refuse a trial that we reasonably believe is being used to collect data in bulk, or that repeats an earlier trial.
Payment
Paid plans are subscriptions, billed in advance for each month or year. Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method at the start of each billing period until you cancel. Prices exclude any taxes, which are added where they apply. If a payment fails, we will try again and let you know; if it still fails, your account drops to an account without a paid plan until payment is made.
4. Changing plan and cancelling
- You can change plan or cancel at any time from the billing portal in your account. When you change plan, the billing portal shows any amount charged or credited before you confirm.
- When you cancel, your plan stays active until the end of the period you have paid for, and you will not be charged again. Fees already paid are not refunded, except where the law requires a refund.
- After a paid plan ends, the account keeps its lists, settings and team, and drops to an account without a paid plan. Choosing a plan again restores full access.
5. Acceptable use, fair use and no reselling
You agree to use AgentData only for lawful business purposes.
Your own use only (no reselling)
Your plan lets your organisation use AgentData data in its own sales, marketing and research, including importing it into your own CRM and sales tools. You may not sell, license, publish or give the data, or lists made from it, to anyone outside your organisation, including your clients, unless we agree in writing.
Fair use
Allowances are for one organisation's normal business use. We may limit, pause or review an account whose use looks like an attempt to copy our database, for example by cycling lists through the technology limit, sharing one account across organisations, or automated access outside the API. We will contact you before taking action, except where urgent action is needed to protect the service.
You must not
- Redistribute, resell, sublicense, or make available AgentData data to third parties
- Build a competing database, product, or service using data obtained from AgentData
- Systematically scrape, crawl, or extract data beyond your plan entitlements
- Share your account credentials or API keys with others
- Use AI assistants, scripts or multiple accounts to get around limits, including limits shared by the users of an AI assistant platform
- Use data obtained from AgentData for spam, harassment, discrimination, or any unlawful purpose
- Attempt to circumvent rate limits, gating mechanisms, or security controls
- Use automated tools to access the service except through our official API
- Impersonate another person or entity
- Use AgentData data to train, fine-tune, or develop machine learning or artificial intelligence models
- Use data in any manner that violates applicable data protection laws, including the UK GDPR, EU GDPR, or CCPA
One API key per person: each person on a team has their own. API keys used from 20 or more unique IP addresses in a single day may be flagged for review.
6. Your responsibilities as a data controller
When you export, download, or otherwise use personal data obtained from AgentData (such as email addresses, names, or job titles), you become an independent data controller for that data under applicable data protection law.
As a data controller, you are responsible for:
- Ensuring you have a valid legal basis for processing the data (such as legitimate interest for B2B outreach)
- Complying with all applicable data protection laws, including the UK GDPR, EU GDPR, Data Protection Act 2018, and CCPA
- Complying with applicable electronic marketing laws, including the Privacy and Electronic Communications Regulations (PECR) in the UK, CAN-SPAM Act in the US, and equivalent laws in other jurisdictions
- Honouring any data subject requests (such as unsubscribe or deletion requests) that you receive
- Conducting your own legitimate interest assessment where required
- Ensuring any communications you send using AgentData data are lawful and comply with applicable regulations
AgentData provides data for legitimate B2B purposes. We do not authorise or condone the use of our data for unsolicited consumer marketing, mass emailing without a lawful basis, or any other activity that would violate applicable law. If you are unsure whether your intended use is lawful, we recommend seeking independent legal advice.
7. Data processing agreement
If you require a Data Processing Agreement (DPA) for your use of AgentData, please contact legal@useagentdata.com. We provide a standard DPA for customers on paid plans.
8. Data accuracy
AgentData data is sourced from publicly available web pages and is provided on an “as-is” basis. We make reasonable efforts to ensure accuracy but we do not guarantee that any information is accurate, complete, current, or suitable for any particular purpose.
You are responsible for independently verifying any data before relying on it for business decisions, outreach, or any other purpose.
If you find incorrect data, you can report it via our website or email support@useagentdata.com and we will investigate.
9. Intellectual property
The AgentData service, brand, website, software, and compiled database are the property of DragApp.com Ltd or its licensors.
While individual data points (such as a company's publicly listed email address) may be publicly available, the compiled and structured dataset, including our classifications, technology detection, and scoring, is proprietary.
Your account grants you a limited, non-exclusive, non-transferable licence to use the data within the scope of your plan for your own internal business purposes.
10. Export watermarking
CSV exports may contain invisible unique identifiers (including row ordering patterns and zero-width characters) tied to your account. Redistribution of exported data is prohibited and traceable. Evidence of redistribution is grounds for immediate termination of your account without refund.
11. API and MCP terms
These terms apply equally to the REST API, the MCP server and connectors in AI assistants. When you use AgentData through an AI assistant, the assistant's provider handles your conversation under its own terms; see our Privacy Policy.
The API and MCP server are provided for programmatic access within the scope of your plan. We reserve the right to:
- Enforce rate limits per plan tier
- Throttle, suspend, or terminate access for abusive usage
- Modify API endpoints, response formats, or features with reasonable notice. The MCP server's address, tools and responses may change without notice; the current address is in our documentation
The API is provided “as-is” without warranty. You are responsible for handling API errors and rate limits gracefully in your applications.
12. Limitation of liability
To the fullest extent permitted by law:
- The service is provided “as-is” and “as-available” without warranties of any kind, express or implied
- We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from your use of data obtained through the service
- Our total liability for any claims arising from your use of the service shall not exceed the total amount you paid to us in the 12 months preceding the claim
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold harmless AgentData, its directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from:
- Your use of the service
- Your use of data obtained through the service
- Your violation of these terms
- Your violation of any applicable law, including data protection or electronic marketing laws
- Your violation of any third-party rights
14. Suspension and termination
We may suspend or terminate your account if we reasonably believe you have violated these terms. We will attempt to notify you before or promptly after any suspension, except where we are legally prohibited from doing so or where urgent action is required to protect the service.
You may terminate your account at any time by contacting support@useagentdata.com or through your account settings.
On termination:
- Your access to the service will cease immediately
- Data you have already exported is yours to keep, subject to your ongoing compliance with applicable data protection laws
- Your account data will be deleted within 30 days
- We may retain certain data as required by law (e.g. payment records)
15. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you via email or a prominent notice on our website. Your continued use of the service after changes take effect constitutes acceptance.
16. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Entire agreement
These terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and AgentData regarding your use of the service.
